Child Adoption policy of the Government of India

The government of India has its own intercountry adoption policy. According to this policy a minimum of 60% of the children must be adopted by Indian couples. 

The majority of the children who come in contact with the adoption agencies are children of unwed mothers. Most children are between 12 and 18 months old at arrival.
Although the adoption-legislation applies for whole India, procedures can differ per state. New Delhi and Mumbai follow almost the same procedure.

The Dutch adoption agency sends the legalised documents and the translated family-report to their contact in India. Then the waiting period starts until a proposal for a child is received. On an average this will take 12 to 15 months. 

After acceptation of the proposal, the matching has to be approved in India, after which the papers are being sent to the court, where the custody-transfer takes place. This procedure takes about 3 to 6 months.

After that the child is escorted to The Netherlands or the future parents from The Netherlands can travel to India to get the child. According to the prevailing laws, in some cases the Mumbai court stipulates that in case of adoption of an older child the parents come to India to collect the child.
